According to prosecution witnessed, all white, Hornsby and a group o ffive white men attacked Neal on the Main street of the twon and shot him at leat seven or eight times, then walked away. Hornsby, however, denies this and says he was walking down the street and saw a group of men unknown to him come out from behind a tree and shoot Neal five or six times. He claims that he did not know the man was Neal. Two other white men are indicted with hi,. They are George Baker and Wiley Baker. Hornsby was positively identified as a member of the murder gang by several witnesses. One of the witnesses at former hearing has since been shot, almost on the very spot where Neal met his death. The man was Police C. P. Stivers. Several persons have been indicted for his murder. Alleged threats against the lives of other witnesses and defendants resulted in the trail judge’s request for protection by the Kentucky National Guard which is now on guard at the court house as the trial proceeds. Judge Little said he forwarded one of the warrants to the sheriff of Jackson county, and the other to the sheriff of Madison county for service. Eleven guards were on duty at Clay county jail today protecting two men already arrested in the case, Frank McDaniels, 24, of Burning Springs, charged with murder, and John M. Quinn, 50, Manchester attorney, charged with conspiracy. Sheriff G. L. Langdon added his word to the request made today at Frankfort for national guard troops when he informed authorities at the capital the situation here is “critical.” The situation which has arisen since the slaying of Judge Stivers is reported to date back to the Baker-Howard-White-Philpot feud of thirty years ago. P. Stivers. While Baker was ordered held pending word from the sheriff of Clay county, D. Y. Lyttle, an attorney formerly from there and brother of the Clay county judge, said Baker was not connected with the slaying, Police said Baker had $8,923 in cash and $30,000 in stocks and bonds and a pistol. He explained he recently retired from the grocery business and came here on a business trip. Four men were indicted in the Stivers slaying and one of them, Frank McDaniel, 24, was convicted and sentenced to life imprisonment. Judge Lowis had refused to join with Commonwealth’s Attorney F. H. Baker, London, and his brother, County Attorney B. B. Baker in their appeal to Governor Ruby Laffoon to send a Kentucky national guard until here April 19. The Baker brothers said in Frankfort they had been warned their lives were in danger. Special to The Courier-Journal. Manchester, Ky., April 16. – Police Judge C P. Stivers, 40 years old, a grand jury witness in an unsolved murder here, was assassinated at 8 o’clock this morning on Main Street and his slayers escaped in a red sedan, the windows of which had been painted white. While officers of Clay, Jackson, Madison and Garrard Counties were in pursuit of the assassins, whose car was reported to have had a Madison County license tag on the front and an Ohio plate on the rear, John M. Quinn, 50, lawyer here, was arrested on a conspiracy charge in connection with the killing. His arrest by Town Marshal T. T. Burchell was on a warrant issued by County Judge J. M. Little. Quin declared he knew nothing about the case. nothing about the case. Officers here were informed tonight of the arrest in Richmond of Frank McDaniel of Clay County in connection with the killing.  The killers’ car was found abandoned in Madison County near Berea.  The shooting occurred exactly at the spot where Alfred Neal, a Negro, was shot down in February. Judge Stivers appeared as a witness before the grand jury for the fatal shooting of Neal by three white men, but the inquisitorial body returned no indictment. Today’s tragedy was attributed to ill-feeling growing out of the Neal case. Judge Stivers was on his way from his home to his office and was in front of the home of Dr. J. L. Anderson when the automobile drove up to the curbing and five or more shots were fired. He was riddled with loads from shotguns. The car, which had not stopped, and which was occupied by three of four men, sped away toward McKee, Jackson County. It bore an Ohio license, but the slayers are believed to have been from Clay County. When officers sought to communicate with officials of other counties it was discovered that telephone wires had been cut between Manchester and Burning Springs, eight miles from here, between McKee and Richmond, Madison County. Deputy Sheriffs Lane Gibson, Bige Hardigee and Isom Langdon, who went in pursuit, learned the killers’ car whizzed through McKee, thirty miles from here, at a speed estimated at sixty miles an hour, a half hour after the shooting. It was headed toward Richmond. Sheriff Joe Bence of Jackson County joined in the pursuit at McKee. Efforts to enlist aid of Madison County officers at Richmond were blocked by the fact the telephone wires had been severed.  Garrard County officers were enlisted in the quest when Madison officials learned the pursued men had turned off the Richmond Road toward Lancaster Judge Stivers is survived by his wife and three children. P. Stivers, police judge of Manchester, was affirmed today by the court of appeals. McDaniel, who was indicted jointly with Tom Baker for the murder, sought a change of venue when his case was called for trial alleging that such a state of lawlessness existed in Clay county and in the city of Manchester that it would be impossible for him to get a new trial. A Rope Placed Around Elmer Hill’s Neck and He is Jerked into Eternity. ABOUT THIRTY MEN DID THE WORK. The expected happened last Wednesday night when a mob of about thirty or forty citizens of Russell county visited the Monticello jail, took therefrom Elmer Hill, who assaulted and murdered little Mamie Wormack, near Russell Springs, conveying him to the mouth of Greasy Creek, in Russell county, and there hanged him until he was dead, his body being left dangling from a tree when the mob withdrew. It is useless to repeat the history of the crime, as a full account of it appeared in the issue of the News of last week. There was no trouble at the Monticello jail. Sheriff Wright was not at the jail with a posse of me. The jailer was called up and the mob made its business known. The jailer seeing that it would be useless to resist, gave up the keys. It is said that the mob who executed Hill was made up of some of the best citizens of Russell county, who felt that they could not longer wait for the death of a man who had committed such a dastardly crime. While a great many will say that it would have been better for Russell county if the law had been permitted to have taken its course, but very few, if any, wille censure the action of the men who participated in putting to death the man who committed the most heinous crime ever recorded in this section of Kentucky or in any other State. It is our understanding that Hill, soon after he was taken from the jail at Monticello, confessed his guilt in the hearing of a Wayne county gentleman, who happened to be up at the time. Even if he did not confess, he left substantial evidence, discarded clothing, which were found at the home of his grandfather. It is reported here, howerer, that Hill’s full confession was made to Mr. Cyrus Dunbar, a merchant at the mouth of Greasy creek, just before he was hanged. He was permitted by the mob to talk to Mr. Dunbar. He stated that he was guilty and that no other person was implicated. He also said that the only thing he regretted was, that he wanted to live so that he could treat three other girls in the neighborhood the same way. We also learn from another source that Hill did not see Mr. Dunbar, and that his confession was made to the mob, but it was substantially what is stated above that he said to Dunbar.  While the law was not vindicated, the world has been made richer, and Russell and her sister counties are happy.
