Frank McDaniel Must Serve His Sentence in Prison

FRANKFORT, Ky., Jan. 10. – The life prison sentence imposed upon Frank McDaniel by Clay circuit court for the murder of C. P. Stivers, police judge of Manchester, was affirmed today by the court of appeals.

McDaniel, who was indicted jointly with Tom Baker for the murder, sought a change of venue when his case was called for trial alleging that such a state of lawlessness existed in Clay county and in the city of Manchester that it would be impossible for him to get a new trial.

The appellate court, in an opinion by Commissioner Charles Creal, held that the evidence showed that McDaniel had been given every opportunity to consult with his attorneys previous to his trial and “that nothing was done to prejudice any right of the accused.”
